By accessing or using PreGradeCards ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

PreGradeCards provides AI-powered card grading analysis, condition assessment, sports card identification, and slab label reading services. Our Service is designed to help collectors estimate card grades before submitting to professional grading companies.

2.1 Important Disclaimer

PreGradeCards is NOT a professional grading service. We do not issue official grades, certifications, or encapsulated slabs. Our analysis provides estimates and predictions only. Actual grades from professional services (PSA, BGS, CGC, SGC, etc.) may differ from our predictions.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Credits and Payment

4.1 Credit System

  • Services are paid for using credits purchased in advance
  • Credit prices are listed on our Pricing page
  • Credits do not expire
  • Credits are non-transferable between accounts

4.2 Refunds

  • Unused credits may be refunded within 30 days of purchase
  • Used credits are non-refundable
  • If a technical error consumes credits without providing results, contact support for credit restoration

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Upload images containing illegal, obscene, or harmful content
  • Attempt to reverse engineer, decompile, or hack the Service
  • Use automated scripts or bots to access the Service without authorization
  • Interfere with or disrupt the Service or servers
  • Impersonate others or provide false information
  • Resell or redistribute our Service without authorization
  • Use our grade predictions to mislead buyers about card conditions

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, and content, is owned by PreGradeCards and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of images you upload. By uploading images, you grant us a limited license to process and analyze them for providing our Service. We do not claim ownership of your images.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Accuracy of grade predictions
  • Uninterrupted or error-free operation
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee that our predictions will match grades from professional grading services. Card grading involves subjective judgment, and results may vary.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREGRADECARDS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Decisions made based on our grade predictions
  • Differences between our predictions and actual professional grades

Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless PreGradeCards, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment
  • At our sole discretion with reasonable notice

Upon termination, unused credits may be refunded at our discretion.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
